1. TERM
This agreement is for the duration set forth in the fee structure. For individual accounts, advertiser will pay based on the length and number of listings. For a Corporate Account, the advertiser will pay based on the fee structure outlined below. Fee terms begin on the date of payment and terminate on the anniversary date of their term. The corporation entering into this agreement shall have an option of renewal.
2. NOTIFICATION OF CONTENT CHANGES
DENTALJOBS.NET agrees to inform Advertiser of any major changes to the website that directly affect their job listings and to allow Advertiser business to maintain the accuracy of DENTALJOBS.NET’s pages.
3. FEE STRUCTURE
Advertiser will pay Dentaljobs.net fees as follows:
One listing – $145 per 30-day listing
Corporate Accounts:
Unlimited listings – $1,495 per year
All Advertisers will receive access to any resumes posted for the position and county in which a job is listed and salary survey results for the positions the Advertiser is seeking to fill.
4. PAYMENT
Advertiser will pay the fee as indicated above upon sign-up. Payment can be made online with a credit card, Paypal, or by sending a check or money order to:

5. RIGHT TO REFUSE UNACCEPTABLE ADVERTISING:
Dentaljobs.net reserves the right to deny any online posting that is unacceptable. Dentaljobs.net does not accept advertising from companies that produce or provide tobacco, alcohol, or pornographic products or services (which Dentaljobs.net shall have complete discretion to define), or their subsidiaries, or foundations funded by such companies whose function is to improve acceptance of such products by the public. This Agreement can be voided by Dentaljobs.net immediately if Advertiser fails to disclose (or conceals or misrepresents) any involvement with tobacco, alcohol, or pornographic products or services. In addition, Dentaljobs.net may in its complete discretion refuse the use of any other advertising that it deems to be inappropriate.
6. USAGE STATISTICS:
Dentaljobs.net makes no guarantee of any level of traffic at any given time. Dentaljobs.net shall not be held liable for any claims as they relate to published or unpublished usage statistics. Dentaljobs.net is not required to provide advertisers with usage statistics.
7. INDEMNIFICATION
Advertiser shall fully protect, indemnify and defend Dentaljobs.net and all of its agents, suppliers, partners, employees and each of their successors and assigns (“Indemnified Parties”) and hold each of them harmless from and against any and all claims, demands, liens, damages, causes of action, liabilities of any and every nature whatsoever, including but not limited to personal injury, intellectual property infringement, fraud, deceptive advertising, violation of any state or federal laws or regulations, property damage, attorneys’ fees and court costs, arising in any manner, directly or indirectly, out of or in connection with or in the course of or incidental to any of Business’ advertising or products or services, or the provision thereof to consumers, and based upon any breach of Business’ representations, warranties, or obligations as provided in this Agreement, REGARDLESS OF CAUSE OR OF ANY FAULT OR NEGLIGENCE OF DENTALJOBS.NET OR THE INDEMNIFIED PARTIES AND WITHOUT REGARD TO CAUSE OR TO ANY CONCURRENT OR CONTRIBUTING FAULT, STRICT LIABILITY OR NEGLIGENCE, WHETHER SOLE, JOINT OR CONCURRENT, ACTIVE OR PASSIVE BY DENTALJOBS.NET OR THE INDEMNIFIED PARTIES.
8. ASSIGNMENT:
Advertiser may not resell, assign, or transfer any of its rights hereunder. Any attempt by Advertiser to resell, assign or transfer such rights shall result in immediate and automatic termination of this Agreement, without liability to Dentaljobs.net.
9. GOVERNING LAW:
This Agreement will be governed by and construed in accordance with the laws of the State of California.
10. FORCE MAJEURE
Neither Dentaljobs.net nor Advertiser shall be liable to the other for any failure or delay in its performance due to any cause beyond its control, including acts of war, acts of God, earthquake, riot, sabotage, labor shortage or dispute, Internet interruption, government acts, or any other condition affecting production or delivery in any manner beyond the control of Dentaljobs.net.
11. MISCELLANEOUS
This Agreement constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior or contemporaneous oral or written agreements. Each party acknowledges and agrees that the other has not made any representations, warranties or agreements of any kind, except as expressly set forth herein. This Agreement may not be modified or amended, except by an instrument in writing signed by duly authorized officers of both of the parties hereto.
